The High Court of Botswana is a superior court of record with unlimited jurisdiction: it hears and determines any civil or criminal case under national law. It sits above lower‑level courts (Magistrates’ Courts, Customary Courts) and below the final appellate court, the Court of Appeal of Botswana.

The High Court has several divisions/locations: its main headquarters is in Gaborone, but branches sit in Lobatse, Francistown and Maun. The Lobatse division handles cases for the southern region of the country.

Why Lobatse - a bit of history & context

The town of Lobatse lies about 70 km south of Gaborone, in a valley near the South African border. It was once a candidate to be Botswana’s national capital; higher altitude (hence cooler climate) and a railway connection made it attractive. However limitations in water supply prevented that.

Despite that, Lobatse retained national‑level importance as the seat of a High Court division. For many years the presence of the court (judges, lawyers, court staff, litigants) shaped a part of the town’s identity and economy.

Role and Jurisdiction of Lobatse High Court

As part of the High Court, the Lobatse division hears civil and criminal cases of any severity - including family law, criminal trials, major civil suits, appeals from magistrates and customary‑court judgments.

It also serves as a review court over lower‑level courts and customary‑court decisions.

Judges who once were expatriates (before 1992) are now all citizens of Botswana.

Recent Changes & Administrative Developments

In 2012 the central administration (and the headquarters of the judiciary) moved from Lobatse to Gaborone after a new court complex was completed there.

As a result, the Lobatse High Court became a regional division rather than the national headquarters. The number of judges assigned to Lobatse reduced accordingly, but the division remains active and fully functional for its jurisdictional area.

Significance for Lobatse & Wider Botswana

Lobatse’s identity remains linked to its role in the judicial system: even today, the High Court division gives the town continued legal importance.

For people in southern Botswana, access to a High Court in Lobatse means major cases - civil disputes, serious criminal matters, appeals - can be adjudicated without travelling all the way to Gaborone.

The existence of the court historically supported local legal professionals, law‑related businesses, and added to the town’s status beyond its industrial/agrarian economy (notably meat processing).
